Dialogs on Civil Procedure and Arbitration in Lisbon
In early March, Eduardo Talamini took part in the symposium of the Portuguese Fiscal Association, in Lisbon. His lecture dealt with the arbitration in public law. On the same occasion, he participated in the “NELB invites” program and was interviewed about arbitration, procedural agreements and early production of evidence by members of the Center for Luso-Brazilian Studies. The Introduction Law to Brazilian Law Standards and the administrative contracts
The Federal Law 13.655/18, which came into force on April 25th, introduces legal basis for the adoption of efficient practices in administrative contracts and the control over them. Some of the main rules of the new Law are under review by the lawyer Guilherme F. Dias Reisdorfer.
ANTAQ begins public hearing for review of the standards about segregation service
On May 25th, ANTAQ has started the public hearing to review the Resolution nº 2.389, which deals with the segregation and delivery of cargo services by the port terminals. Definitive acceptance of works and services under the regime of the Law 8.666
The acceptance of works and services provided in favor of the Public Administration is submitted to a specific legal regime. In spite of express provision in the Law 8.666, many questions and disputes about the acceptance of the contractual subject have been arising. André Guskow Cardoso examines some of these issues.
Law 13.460 – Law of Redemption of Citizenship
The Law 13.460/17 will come into force in June this year in the big Brazilian cities. The Law, that could be qualified as the Law of Redemption of Citizenship, recognizes the leading role of the citizen as a fundamental player in the public law relations. It makes unlawful the conception inherited from the authoritarianism that the citizen is an “administered”, a “subordinate”, an “obstacle” to the development of the government activities. 1st Brazilian Congress of Public Law of Infrastructure (Brasília – June 7th)
The partner Marçal Justen Filho and Marco Aurélio Barcelos Silva are the scientific coordinators of the 1st Brazilian Congress of Public Law and Infrastructure, that will be held on June 7th. Marçal Justen Filho will make a lecture entitled “Why a Public Law of Infrastructure?”; Cesar Pereira will speak about the arbitrability of administrative sanctions; and Rafael Wallbach Schwind will make an presentation about controversial aspects of the new law of ports. The event will take place at the auditorium of the Brasiliense Institute of Public Law.
