New landmark for the railway sector

Decrees nº. 8.129 and 8.134 were published last October. The Decrees define the legal grounds of the new concession model for the rail sector. These regulatory instruments establish the policy of free access to the Subsistema Ferroviário Federal [Federal railway subsystem] and define the structure of Valec, a public company responsible for developing the system of cargo transportation on rails. Superior Court of Justice confirms validity of arbitration based on arbitration clause

On December 12, 2013, the 3rd Panel of the Superior Court of Justice unanimously confirmed the validity of the arbitration process and the tribunal’s decision in the “Itiquira case”. The decision reinforces the case law on the effectiveness of arbitration clauses and the relevance of the conduct of the Parties in the course of the arbitration. Check out the decision.

Symposium on arbitration – OAB/PR

Public Procurement – basic design – unilateral change

Earlier this month, the Federal Court of Audits issued a recommendation in a Fiscobras report for the suspension of some federal works. Among the problems, the irregularity of the basic design of works was discussed. Such deficiencies have become quite common for works undertaken by the Government. On the other hand, these defects are to a certain extent related to the prerogative of unilateral change of administrative contracts held by the Government. ANP: public hearing – hydraulic fracturing (fracking)

The hydraulic fracturing or fracking is a technique used for explotion of gas and oil that are located at great depths and until then inaccessible to exploitation. There are several benefits arising from their use. However, there are some controversial aspects regarding the damages it may cause to the environment and human health. A public hearing was held by ANP on November 21 to discuss the implementation of unconventional hydraulic fracturing in the next Pré-Sal Bidding rounds. Brasile Infrastrutture – Rome – November 28

Brasile Infrastrutture will be held in Rome on November 28, 2013. The event, organized by the Brazilian Embassy in Rome and the Brazil Infrastructure Institute, will address the opportunities of investment in the Brazilian transport sector. The program includes lectures by distinguished speakers and networking in meetings of mutual interest. The partner Cesar A.
