IV Petrônio Muniz Brazilian Moot on Arbitration

Between the 10th and 12th of October, Curitiba will host the IV Petrônio Muniz Brazilian Moot on Arbitration, at Positivo University. Paulo Osternack Amaral will act as arbitrator at the event, with the task to evaluate the performance of competing teams. Among the participating universities are the Federal University of Paraná (UFPR), whose coaches are Eduardo Talamini, Diego Franzoni and Isabella Moreira de Andrade Vosgerau, and the Pontifical Catholic University of Paraná (PUC/PR), which is coached by Daniel Siqueira Borda.

II International Legal Forum

From 22 to 24 October will be held the II International Legal Forum, in the city of Ponta Grossa (PR). The event includes a lecture by Paulo Osternack Amaral regarding Arbitration and Public Administration.

Global Price Contract: unifying the doctrine of the TCU

The global price contract, established by art. 6 of Law n.8666, has generated many practical difficulties for both contracting parties and the supervising organs. The Federal Court of Accounts, through court decision 1.977/2013, standardized the understanding of monitoring procedures related to this regime. Health Social Organizations

Law nº. 9.637/1998 established the importance of the third sector to fulfill certain public purposes and introduced in the Brazilian legal system the figure of social organization. There is a clear intention to allow the association between government and nonprofits entities in the health sector, to participate in a complementary way in the public health system. However, these entities have suffered severe criticism especially because of nonconformities observed by external control. Read more about it in brief article from Karlin Olbertz Niebuhr.

Business Law, CISG and arbitration: seminar EMAP – CAM-FIEP (Curitiba, Brazil, October 18)

CAM-FIEP, the Curitiba-based arbitration center presided by Cesar A. Guimarães Pereira will hold on October 18, together with the Paraná Judges School, the seminar “Business Law and Arbitration”, with conferences and panels on the UN Convention on the International Sales of Goods (CISG), business contracts and arbitration. Eduardo Talamini¸ Paulo Osternack Amaral and Felipe Scripes Wladeck are among the speakers or instructors. Ministro João Otávio de Noronha, of the STJ (Superior Court of Justice), will give the closing conference on the social function of business contracts; the opening conference will be delivered by Adriana Braghetta, who will discuss the prospects for any change in the arbitration law.
