Drink Driving Law and the Principle of Proportionality

Drink Driving Law n. 12,760/2012 was published in December 21, 2012. It altered Brazilian Traffic Code rules, increasing administrative penalties applied to drunk drivers. After six months from the enactment of the Law, it is necessary to examine the proportionality of the sanctions that have been applied. Curitiba issues regulation on the Differential Public Procurement Regime

The Municipal Decree n. 884 published in May 24, 2013, rules on the Differential Public Procurement Regime applicable for direct and indirect governmental entities of Curitiba. The decree is justified mainly by the need for adequacy and uniformity of administrative procedures for the conclusion of contracts by the municipality to the rules of Law n. 12,462/2011 and Federal Decree n. 7,581/2011, which govern the Differential Public Procurement Regime. The bill of the new regulatory framework for mining

This month the President of the Republic sent to the Parliament Bill n. 5,807/2013, which “provides for the mining activity, creates the National Mineral Policy Council and the National Agency for Mining – AMN, and other matters”, under an emergency regime (article 64, §1º of the Federal Constitution). The bill changes the system of mineral research and production in the country, establishing a new regulatory framework for the sector. Ricardo Barretto de Andrade’s article analyzes the main novelties of the Bill, with focus on proposed changes to the legal regimes of mineral exploitation.

Launch: Revista de Direito Administrativo Contemporâneo – ReDAC
