Class Action: passive legitimacy of the legal representatives of private entities

rnrnIt is common to include the legal representatives of private entities as defendants in class actions challenging actions in which the private entity took part. However, their direct or automatic passive legitimacy cannot be derived from Law n.� 4.717/65, except in very specific cases. The article written by Andr� Guskow Cardoso examines this situation.rn

Reverse Logistics (Decree n.º 7.404/2010)

rnrnOn December 23rd 2010 Decree n.� 7.404 was published, regulating the National Policy on Solid Waste (Law n.� 12.305/2010). Reverse logistics is one of the mechanisms touched on more thoroughly by the Decree. However, several legal issues surrounding this mechanism still require further study. Rafael Wallbach Schwind and William Romero address some of these issues.rn

Law establishing the National Transportation System is published

rnrnJanuary 7th was marked by the publication of Federal Law n.� 12.379, which establishes the National Transportation System. The Law describes the composition of the National Transportation System in a thorough and systematic manner and establishes rules for the application of resources and the acts in its competence. In this brief article, Rafael Wallbach Schwind analyzes some of the rules imposed by the new Law.rn
