II Debate Series: Arbitration and Corruption (Curitiba – August 4, 2016)

It will take place on August 4, the 2nd Arbitration Debate Series, entitled Arbitration and Corruption. Cesar Pereira will be the chair, Rafael Wallbach Schwind will deliver one of the lectures and Marina Kukiela will lead the discussions. Spontaneous retirement of public employees

The Supreme Court ruling on Direct Unconstitutionality Action 1.721-3/DF and 1770-4/DF declared the unconstitutionality of paragraphs 1 and 2 of article 453 of the Labor Code, defining that social security retirement does not extinguish the employment relationship, so that the employee can continue working in the same job. However, there still is uncertainty on the effects on government employees. The ongoing trial of the Extraordinary Appeal 655.283-DF in the Supreme Court, with general repercussion, will decide on the severance pay for resignation after spontaneous retirement; public employee stability, by article 41 of the Constitution; employees reintegration in case of dismissal before the ruling on those direct unconstitutionality actions; the accumulation of proceeds from the general pension and salaries by the public employer; the termination of the employment relationship due to achieving the limit age or the possibility of tenure in public employment. Law 13,303/2016: the new law of the (former) state-owned companies

Law 13.303 of June 30, 2016 contains several rules on the operation of state-owned companies. The relevance of the matter is significant, especially in times of Lava Jato when it becomes even more evident the need for mechanisms to control deviations and to guarantee the efficiency of such entities. XVII Congress of Administrative Law of the State of Paraná (Curitiba – 23 to 26 of August 2016)

Between the 23rd and 26th of August, the Institute of Administrative Law of Paraná- IPDA promotes its 17th Congress of Administrative Law at the headquarters of OAB/PR, in Curitiba. The event will be held in memory of Prof. Manoel de Oliveira Franco Sobrinho and in honor of Prof. Marçal Justen Filho. On the 23rd, the honoree will deliver a lecture on the (In) Efficiency of Public Administration and the New Civil Procedure Code. On the 25th, Cesar Pereira will join the debate with other guests on the (In) Efficiency of Public Administration in Public Procurements. UNCITRAL Vietnam Workshop: CISG and Government Procurement (Hanoi – November 24)

On November 24, UNCITRAL – United Nations Commission on International Trade Law will hold a seminar in Hanoi, Vietnam, on the harmonization of trade law and its prospects for the Asian countries. Cesar Pereira is one of the foreign speakers invited by UNCITRAL and will lecture on the application of CISG to government purchases. Other foreign speakers will be Ingeborg Schwenzer, Luca Castellani, Lisa Spagnolo, Fan Yang and Gary Bell.
